Conflict of interest

Who are your agents really acting for?by Julian Male

In terms of the conveyance process when buying property in Thailand, it is not unusual for a lawyer to act for both the buyer and the seller (or agent). Although by and large there is no general rule prohibiting this practice, it is strongly discouraged by courts and professional bodies in all legal jurisdictions throughout the common and civil law world, the rationale being that loyalty to the client must be undivided, particularly where there are two parties giving instructions with countervailing interests.


In days gone by, English courts were littered with cases of lawyers acting for both vendor and purchaser. The pervading issue soon became apparent in cases where defects in property title or contracts with unfair terms detrimental to one party would render the lawyer liable if they did not disclose these: thus they compromised their own interests and those off their clients.
Using the common law notion of fiduciary, a lawyer must act for and on behalf of their client in circumstances which give rise to a relationship of trust and confidence. By definition the term fiduciary is derived from the Latin fides, meaning faith, and fiducia, meaning trust.


In spirit it is a relationship where one person justifiably reposes confidence, good faith, reliance and trust in another whose aid, advice or protection is sought in a professional matter. Although the concept of fiduciary is new in Thailand, recent examples are now enshrined in the Security and Exchange Act, 2008, which recognizes a comprehensive fiduciary duty of care and loyalty. On appearance it captures executives and managers from listed public companies, yet it will eventually capture directors from private companies including lawyers and real estate agents.
While the Thai legal system does not have a separate equitable body of law by comparison to English common law, good faith and honest dealing is a foregone conclusion under section 6 of the Commercial and Civil Code, and the distinguishing or overriding duty of a fiduciary is the obligation of undivided loyalty.


Conflicts are often difficult to avoid yet the key to managing them is mandatory disclosure. Included in the most sophisticated legal jurisdictions such as the US or Australia, Thailand is no exception in allowing the practice whereby a lawyer may act for more than one party to a transaction where both parties have provided informed consent. Informed consent means that both parties have given consent with full knowledge of the conflict and advice should be given to the parties in writing to obtain an independent legal opinion. If contested, the onus is also on the lawyer to prove that they have advised the client and the client consents in writing to the transaction.
Sound risk management practice would dictate that suspected conflicts can be at least avoided or sanctioned if legal practitioners seek advice from the Law Society of Thailand and furnish that advice to the parties in writing. In the high end luxury property sector this practice would ensure confidence that the buyer’s lawyers and real estate representatives are acting honorably.
While the freedom to act for both parties is acceptable, it has its limitations, and raises a key question: Whose interests is the lawyer really serving?


There have been examples of lawyers accepting kickbacks or gifts from real estate agents and developers to finesse the sale of a property through all the administrative and legal hoops that would ordinarily provide some protection for the buyer. Particularly, in luxury property deals, it can become a costly nightmare if buyers are unaware of issues that can hinder or even freeze the development of their property. Examples of such can include encumbrances on the property such as mortgages or servitudes rights to access roads or water to parties unbeknown to the buyer.


If caught out, undisclosed representation and behind-the-scene dealings can subject a lawyer to disciplinary hearings, the denial or disgorgement of legal fees, or in some cases (such as the failure to make mandatory disclosure) criminal proceedings.
Of course it is a common practice for real estate agents to work closely with lawyers, especially in resort areas where property sales represent a significant portion of lawyers’ incomes, but buyers will be happy to know they have a cache of legal armory available if the deal fails to conclude due to negligent and misleading conduct on the part of their representatives. As fiduciaries, lawyers and real estate agents in Thailand fall under sections 797,798 and section 807 of the Commercial and Civil Code, and can be held liable for any injury resulting from negligence.

Asia's First Conference on Fractional Ownership

Samui, Phangan land prices overvalued?

THE Chamber of Commerce of Suratthani has issued an urgent letter to the Finance Ministry to protest what it thinks are the overly high prices of lands fixed for Koh Samui and Koh Phangan by the Treasury Department. The prices represent an average increase of 200 percent. It said the land valuations were higher than the actual market prices. Theerakit Wangmutitakul, the Chamber president, told Finance Ministry caretaker Korn Jatikavanit that the new land prices set by the Treasury Department for 2008-11 did not reflect the real prices in the market and that they could be detrimental instead of helpful to the two islands’ economies.

Mr. Theerakit said property investors would be discouraged to put their money in Samui and Phangan because the new land prices are too high, and might instead move to other destinations.
The Chamber’s letter complaint was sent after landowners affected by the new land prices expressed their apprehension to the Chamber. Theerakit urged the Treasury Department to reconsider the new land prices it has set for the two islands.

“On behalf of the private sector, we would like to ask the concerned agencies and officials to consider the land prices which have recently been adjusted; the prices do not reflect the actual market and economic situation on Koh Samui. The exaggerated increase can result in the suspension of the economic growth and block potential investors and land purchasers from choosing Samui and Phangan as their investment destinations,” Theerakit said.
Theerakit said that they proposed more realistic land price adjustments for consideration by the Treasury Department “so that we can have the real prices that are not so high like what the Treasury Department has set."

Meanwhile, Rep. Choomphol Kajana, a member of the Democrat Party from Suratthani, said he has also received a letter from those who are affected by the “inflated” land price valuations and that he was ready to coordinate with the Finance Ministry to solve the problem.
A source from the Treasury Department has admitted that the land prices on Koh Samui and Koh Phangan it set were in fact higher than their real prices and that when the prices were fixed, the department factored in the highly competitive market, wherein prices move up continually. The source added that the Treasury Department was in the process of readjusting the new prices to reflect the reality in some areas. But the Treasury Department said that land prices on Koh Samui and Koh Phangan could not be brought down because they are major tourist destinations where land prices are boosted up all the time. It claimed that in some areas, the real land prices are higher than what the Treasury Department has evaluated. For example, from Chaweng beach to Laem Son within 60 meters from the sea, the land price in 2004-07 was Bt 2,500-Bt10,000 per 4 square meters, but the land price in 2008-11 is Bt 6,250-Bt50,000, or an increase of 150-400 percent.

The old price of land in Lamai beach within the range of 40 meters from the sea was Bt5,000-Bt 7,500 per 4 square meters, but now it is Bt35,000, or a 366.66-600 percent increase.
In Koh Tao and Koh Nang Yuan the old price of land within 40 meters from the beach was Bt750 per 4 square meters, but the price now is Bt8,000, an increase of 966 percent. —

Phuket Selected as "First Choice"
for New Asean Summit




PHUKET is the front-running candidate for the rescheduled Asean Plus Six summit, according to the organisation's Secretary General, Dr Surin Pitsuwan.

Dr Surin said today that he will talk to Prime Minister Abhisit Vejjajiva this evening and recommend that the island be the place for the important gathering of regional leaders.

The Governor of Phuket, Wichai Praisa-Ngob, has backed the island and sees the Asean summit as a great boost for the local tourism industry.

Phuket was originally going to hold the summit but island resorts proved to be too popular over the Songkran-Easter break.

By the time officials came to decide, the island's prime resorts had been booked by holidaymakers to levels that meant there was no space for such a large-scale summit.

The rest, as they say, is history: the Asean Plus Six, already postponed after Bangkok's airports were invaded last November, moved to Pattaya, and so did the red shirts.

Last weekend they invaded the Pattaya resort where the summit was due to take place, and the leaders of 16 nations were soon heading for home.

Dr Surin told the media this afternoon that the shooting of yellow shirt leader Sondhi Limthongkul today in Bangkok was also a consideration that pointed towards Phuket as the most secure destination.

Phuketwan has advocated Phuket for the summit because it is an island, with one bridge on and one bridge off, and a checkpoint where buses and other vehicles all need to pass.

There are certainly some other practical considerations.

The island, deprived of adequate government funding for years, has no large conference centre, even though the benefits of such a development are obvious.

Given the lead time of two to three months before the region's leaders can fit another gathering into busy agendas, it should be possible to come up with a solution to the issue of meeting facilities.

One concern last time was spreading the many delegations over many resorts, which would have been the only was the summit could have been held then on Phuket.

In the low season in two or three months time, it should be possible to block-book plenty of accommodation at one or two leading resorts.

The rest is relatively simple.

As the Governor said today, the summit would be a great boost to Phuket in the low season and an opportunity that the island should be grateful to take up if all goes well in the decision-making process from here.

The Prime Minister has had pleasant things to say about Phuket after previous visits, which probably should see the island emerge with the summit.

A decision is expected shortly.

"Wild Bear" Buys Kata Penthouse on Phuket


SURVIVAL is definitely the main thought going through the minds of many property people on Phuket these days, but who'd have thought that up would pop Edward ''Bear'' Grylls?

Bear, if you haven't heard of him, is quite well known in the US for his survival program Man vs Wild on the Discovery channel.

In Britain, he also has a following through another show, Born Survivor.

And now the Bear has a new lair, and it's on Phuket.

The people at Kata Rocks say he has just signed up for a Club Penthouse at the Kata Rocks development, on the headland at the south end of the beach, looking out towards Crab Island (Ko Boo).

If Bear does for Kata Rocks what Formula One racing champ Kimi Raikkonen has done for Outrigger Serenity Terraces Resort in Rawai, the Kata Rocks team will be more than pleased.

The marketing benefits of having someone famous buy one of your properties are becoming startlingly obvious.

So be aware, if you happen to be in that neighborhood of Kata, that there's a Bear out there.......

The adventurer and tv personality has, from all accounts, just the kind of eating habits needed to survive the wilder regions of Thailand.

Bugs, live snakes, live frogs and the fluid from an elephant's dung . . . it seems he has come to the right place.

Bear, 34, was a trooper in Britain's SAS special forces when he broke his back in three places in a parachute jump at the age of 21.

"Lying in a hospital bed with the doctors wondering if he was going to walk again, Bear set a goal to climb Mount Everest," says the Kata Rocks media release.

"At the age of 23, Bear became the youngest Briton to climb the mountain and survive."

He has since gone on, so they tell us, to take a Rigid Inflatable Boat from the US across the Arctic to Britain.

He has also taken a jet ski around Britain (on the water, we presume), he has the world record for the highest dinner party held (below a balloon at 25,000 feet) and he has also taken a powered paraglider higher than anyone else over Mt Everest.

"Bear has also written several books and is an accomplished motivational speaker," the Kata Rocks people tell us, and motivation is certainly something the Phuket property business could use right now!.

All this along with his TV work means that he has been in demand on the chat shows in both the US and Britain and has appeared on Oprah Winfrey, David Letterman and Jonathan Ross amongst others.

This month he is on the front cover of Men's Journal in the States and he has been voted seventh coolest guy in the Britain.

Apparently when he is not out in the wild, drinking elephant fluids, Bear likes to enjoy the finer things in life with his family.

Which brings us to the Club Penthouse in Kata Rocks on Phuket.

Mr Bear said: "I guess in part that I make a living by eating some pretty disgusting things to show how to stay alive if you are in a survival scenario".

"But when I want to just chill out with family and friends, then I try and pick places that are discreet but spectacular".

"Kata Rocks is both of those in abundance. A very special hideaway."

Kata Rocks, designed by Hong Kong-based architects Original Vision, is on the headland between Kata beach and Kata Noi beach, two of the best on the island.

The Kata Rocks people say sales have been "extremely strong" despite prevailing market conditions, with almost half sold off plan in the first few months of 2009.

Construction is due to begin in June 2009 and the project should be completed by the end of 2010.

Thailand Property Sales Could Fall 10%

Political chaos and low interest among foreigners takes a toll:

The Thai property market will see sales decline by more than 10 per cent this year as the political uncertainty takes its toll on the already battered economy, property experts said.

Thai Condominium Association president Atip Bichanond said the dire outlook for the country's 2009 GDP, which the government now forecasts will contract by between 5 and 6 per cent - compared to a projected decline of 3 per cent before the latest flare-up in the political conflict - would have a negative impact on the property market.

"We believe the property market in Bangkok and its suburbs will decline by more than 10 per cent this year compared with last year. Home-buyers are concerned about future earnings, with the country's GDP expected to decline by more than 6 per cent," he said.

Atip added that the condominium market will be worse-hit than the low-rise residence market, which includes detached houses, double houses and townhouses, because demand among foreign buyers - the main target market for condominium projects - has dropped significantly due to both the global recession and the local political turmoil.

"We suggest property developers revise their business plans and exercise caution when selecting locations for their residential projects, and that they carefully manage their cash. This will help them survive the crisis," he said.

The association had earlier estimated the property market would stay flat or grow by 5 per cent this year in the wake of the government's decision to extend property-tax incentives.

Meanwhile, international property agency Knight Frank Charter (Thailand) has postponed its home show, Taste of Living, originally scheduled for April 22 to May 3 on Siam Paragon's M Floor, until October. The company's managing director, Phanom Kanjanathiemthao, said the show had been delayed because of concerns that the political turmoil would dampen demand among home-buyers.

"Based on my experience, home-buyers will likely delay decisions on whether to buy until two or three months after the easing of the political crisis. Siam Paragon was booked solid in two to three months time, so we had to postpone the expo till October," he said.

Real Estate Information Centre (REIC) director-general Samma Kitsin acknowledged that political strife this Songkran had hurt the property market, which he said would decline by as much as 10 per cent this year, compared to the centre's earlier prediction that the market would be flat or even grow by nearly 5 per cent.

The property market faced the twin burdens of the US sub-prime mortgage crisis and the domestic political problems, he said.

Since the emergence of the sub-prime crisis, property firms developing residential projects for foreign buyers had seen demand for residences in Thailand among foreigners drop more than 50 per cent, he said.

The domestic property market took a big hit from the Songkran political chaos. The residential market in Bangkok and its suburbs is expected to decline by more than 10 per cent from 82,000 units last year to between 72,000 and 73,000 units this year, he said.

Thai Real Estate Association president Somchao Tanterdtham said property developers would need to slash their investment budgets. Those planning to launch new residential projects will have to think carefully about the locations, and research their target clientele carefully, he said.

Demand for residences priced below Bt1.5 million per unit will take the biggest hit from the economic slump, while demand for projects priced between Bt2 million and Bt5 million may hold steady, depending on location and other details of the particular project, he said.

Hong Kong Billionaire Says It’s Time to Buy


The "Oracle of Hong Kong" has spoken. And his message: it’s time to consider buying stocks and real estate !!.

Li Ka-Shing reported on Thursday that his companies had severe profit declines in 2008, but he said that “if you buy in a slow market, in the medium term you get good returns,” The New York Times’s Bettina Wassener reported.

The proclamation on Thursday by Li Ka-Shing, the self-made billionaire who controls some of Hong Kong’s largest companies and carries enormous sway among investors throughout Asia, was made at a rare public appearance.

Exuding confidence, Mr. Li joked with reporters and looked anything but depressed about the sharp fall in profit his companies reported Thursday.

Whether Mr. Li is proved right about stocks and property — and he certainly has a lot to gain personally if he is right — his comments come at a time when stock markets have rallied on hopes that the economic slump may be bottoming out.

“If you have money in your pocket,” Mr. Li said, consider buying into stocks. As for the property market in Hong Kong, he said, “history tells us that if you buy in a slow market, in the medium term you get good returns.”

Mr. Li advised against borrowing to invest in what remains a shaky and volatile environment.

Even though couched with caution, Mr. Li’s comments were enough to echo around the investment world and helped send the Hang Seng index up 3.6 percent Thursday.

Mr. Li is the man the local media call “Superman” and liken to the investor Warren E. Buffett, who controls Berkshire Hathaway. Considered one of Asia’s most powerful men, Mr. Li is also one of the continent’s most generous philanthropists.

In the last year, as the economic crisis has dragged on and deepened, Mr. Li has jumped in from time to time to try to restore confidence.

Last September, shortly after the collapse of Lehman Brothers caused the world financial system to convulse, savers in Hong Kong lined up outside the Bank of East Asia, one of the territory’s best-known and biggest banks, responding to rumors that the bank was in trouble. Mr. Li let it be known that he had been buying shares in the bank, an expression of confidence that quickly helped put an end to an old-fashioned bank run.

And this month, HSBC was trying to raise $18 billion in a rights offering, prompting the bank’s shares to fall sharply. A majority of local residents here own shares in the bank, which is now based in Britain but has its roots in Hong Kong. When it appeared that the rights offering might falter, Mr. Li — along with several other Hong Kong tycoons — pledged to put about $300 million of his own funds into the issue.

Still, it has been a difficult year for Mr. Li, and the Superman title sat a little awkwardly on him on Thursday, after Cheung Kong Holdings and Hutchison Whampoa, the flagships of the property-to-ports-to-electricity conglomerate he controls, both reported declines in net profit of more than 40 percent for 2008.

Small wonder, given that the rapid slowdown in the global economy had tipped Hong Kong, along with the United States, Japan and others, into a recession and put a damper on the breakneck growth of neighboring China.

Rental and property prices in the territory, a mainstay of the conglomerate’s earnings, are expected to tumble further this year, hitting developers hard.

But the Cheung Kong group is not just any Hong Kong company, and Mr. Li is not just any Hong Kong company chairman. Thursday’s event was not just any annual news conference, but the pinnacle of the Hong Kong earnings season, complete with a boisterous media scrum that regularly lends the bespectacled and affable Mr. Li the aura of a pop star.



The complex network of companies Mr. Li controls — three of them members of Hong Kong’s benchmark Hang Seng index — epitomize the hustle and bustle of entrepreneurial Hong Kong and its roller-coaster economy.

And Mr. Li himself has the kind of rags-to-riches history that inspires every Hong Kong resident. The Cheung Kong group and its various interlinked companies grew out of the humblest beginnings imaginable: a plastic-flower manufacturing business the young Mr. Li set up in the 1950s.

Five decades later, Mr. Li is now one of Hong Kong’s leading developers of residential, commercial and industrial properties — about one in seven private residences here were developed by the group.

Hutchison Whampoa, of which Mr. Li also is chairman, operates businesses as diverse as ports, hotels, supermarkets and drugstore chains, and is a major telecommunications operator in Hong Kong and abroad.

Cheung Kong Infrastructure, headed by Mr. Li’s son Victor, and HK Electric, one of the territory’s dominant power companies, also belong to the Cheung Kong/Hutchison stable of businesses.

Together, these businesses are a cross section of Hong Kong’s economy and reflect more than any other company the territory’s boom-to-bust character: riding the wave of Asia’s breakneck growth in recent years, and now suffering in line with the slowing global economy.

Mr. Li’s personal fortune has fallen as well, having slipped to 16th in the Forbes annual ranking of the world’s richest people, down from 11th in 2008, with a fortune now worth $16.2 billion — down from $26.5 billion a year ago.

Thailand - Foreigners Looking for Investments !!


Declines in the prices of land and residential projects have prompted some foreigners to expand their investments in Thailand's property market, especially condominiums.

According to a survey by The Nation conducted last week, foreign investors are confident that it is a good time to buy Thai property, both in Bangkok and upcountry.

Some have shown a strong interest in buying depressed assets, which are going for 20 to 30 per cent less than last year.

Interest is also being shown in undeveloped land for the purposes of developing residential projects, as land prices are down 10 to 20 per cent from last year.

Hub Soon Global Corporation Singapore subsidiary United Motor Works (Siam) has set up a joint venture with Chiwathai, called Chiwathai Hub Soon, to develop a low-rise condominium project. Worth Bt350 million, the project is called The Surawong by Chiwathai Hub Soon.

The company also plans to buy undeveloped land and take over existing residential projects worth nearly Bt1 billion this year and next, director Henry Heng said.

"We believe that Thailand's |property market [is attractive to] foreign investors, as land and |residential project prices are now cheaper than last year," he said.

Property management firm Akando, whose clients include Lizmans Property Fund, plans to take over a residential project on Rama IX Road in the capital worth Bt2 billion this year. The project is already under construction but the owner wants to sell. This follows Akando's purchase of three other Bangkok condominium projects in Lat Phrao, Suthisarn and Rama III Road, starting last year.

Managing director Joel Feldman said the company has a strong interest in buying or taking over property projects, with land and residential prices having dropped significantly because of financial difficulties faced by land and residential project owners. Almost all of these owners have lowered their prices in an effort to secure sales, he said.

"We believe this is a good time to invest in Thai property, because we expect the US economy to recover in the last quarter of this year, which should drive Thailand's economic recovery," he said.

ECC Group, a Netherlands-based retail developer, has set aside an investment budget of US$90 million (Bt3.24 billion) to develop a large-scale shopping mall called Promenada in Chiang Mai.

Chairman and founder Dion LJ Heijmans said revenue from shopping malls in Asia is projected to grow by more than 10 per cent a year, compared to growth of just 4 to 5 per cent for the group's Promenada brand in European markets.

Having chosen Chiang Mai for its first project in Thailand, ECC will next consider entering the Bangkok market.

Heijmans said construction of the Promenada on Chiang Mai's Ban Sahakorn Road would start by year's end, with the opening scheduled for the last quarter of 2011.

The group is also seeking a good location in Bangkok with space of at least 100,000 square metres for a two-storey shopping mall. Other potential locations include Phuket, Hua Hin and Pattaya, he said.

Koh Samui to Host
- Miss Thailand Universe Pageant

Suratthani Gov. Pracha Taerat will nominate Koh Samui as venue for the skills workshop for contestants in the forthcoming Miss Thailand Universe pageant. The workshop is scheduled in between 21st-25th March.

The governor said that holding the workshop on Samui could generate a lot of publicity for the island and boost local tourism in the process. The Koh Samui Tourism Promotion and Development Board has endorsed the governor’s bid to have the beauty pageant workshop held on the island.

The committee will ask the Samui Municipality to release Bt1 million as expenses in hosting the beauty contestants and the pageant’s staff. It would also ask hotels on the island to offer rooms for the six-day stay of the Miss Thailand Universe participants.

Mrs.Wanwalee Tantikan, president of the Koh Samui Spa Association, said that tourist interest about the island would be reignited should Samui win its bid as venue for the workshop. Spa, she said, is one of the signature products of Koh Samui.

The industry, she added, would benefit a lot from the visit of the beauty contestants.

Thailand - The Tourists are Returning !

BANGKOK: -- The private sector is increasingly relieved by signs of a recovery in tourism and the high probability of over 12.7 million foreign tourists this year, according to the Thai Travel Agents Association.

"Foreign tourists are returning - and we believe that by the third and fourth quarters the situation will get much better - and the number of foreign tourists is highly likely to exceed 12.7 million and will probably reach 14 million," said Anake Srishevachart, chief adviser to the association.

Mr Anake said foreign tourists - especially from China and Japan - were expected to start travelling to Thailand again by April and May this year after the Thai government has completed its trade missions and roadshows in the two countries later this month.

According to the Thai Travel Agents Association, the number of foreign tourist arrivals last year was 12.7 million, a significant drop from 14.4 million in 2007.

About 54% came from East Asia and around 28% from Europe, while the rest came from the United States, South America, the Middle East and Africa.

The association's positive projection came despite the number of foreign tourist arrivals for the first two months plunging by 38.5% year-on-year to 292,000.

"It is a must, therefore, for the government to beef up public relations activities, particularly in those two markets," said Mr Anake.

He also urged the government to speed up marketing campaigns among travellers from Asean and those who participate in meeting, incentive, convention and exhibition (Mice) events.

Sakkarin Chorsawai, director of the Thai Hotels Association (THA), also suggested that the government promote more seminars upcountry to help smaller properties.

Asia Sense Invests in Samui


KOH SAMUI : Amid the downturn, hotel developer Asia Sense Group has confidence in the tourism market in Samui, where it is launching Asia Spirit Lodge & Spa, its second hotel on the island, with an investment of 72 million baht, said executive director Jean-Pierre Verjus.

"Tourists are still travelling but they just spend less time and money," he said. "With these limitations, they will be more selective and will tend to choose a quality destination to relax. And Samui is that choice."

Foreign tourists visiting Samui usually spent a month in Thailand and travel to several destinations including Bangkok, Pattaya and Chiang Mai. With the recession, some will shorten their holiday to only two weeks and not visit so many destinations, said the Belgian, who has spent 17 years on Samui.

"We need to work harder this year and try to tap every target," he said.

After roadshows in London and Bangkok last month and in Berlin this week, the group plans to attend tourism fairs in Asia and Europe in the second half of the year.

The group's second hotel, Asia Spirit Lodge & Spa, is on a two-rai plot on top of a hill near Baan Taling Ngam, in southwestern Samui, which the group has leased for 30 years. It has 21 Indochinese-style rooms priced between 4,500 and 7,500 baht a night.

Mr Verjus, 45, said the hotel's highlights were privacy and a panoramic sea view over the National Marine Park and Samui's neighbouring islands. The company is targeting an occupancy rate of 35-40% this year and 60% in 2010. It expects to reach a break-even point within eight years.

He said Baan Taling Ngam was an emerging location in Samui as the island's famous Chaweng and Lamai beaches are now full. At least four five- and six-star hotels are expected to open in Baan Taling Ngam, including Grand Hyatt, Club Med, Marriott and Conrad, which would also have Samui's first marina near its site.

Asia Sense was set up five years ago with registered capital of 4 million baht. It is equally held by Mr Verjus and two Thai investors - the owner of a Thai restaurant in Belgium and the owner of the Samui construction firm Advantage Properties, which has also built projects in Chiang Rai.

The group's first venture was Bang Kao Tropical Boutique Residence & Spa, built on a leasehold plot from 2005. Eight of its 28 units are owned by the group. The units include three hotels and 15 villas operating as hotels with room rates of 1,500 to 7,500 baht a night, targeted at family tourists.

"Some buyers stayed only two weeks a year so they decided to rent out their units, which are operated as hotels by the group," he said. He expects occupancy to be down to 60-70%, from 70-75% last year, due to the downturn.

The group also plans to invest around 50 million baht to develop a boutique hotel with 30-40 rooms on five-to-seven rai by the Mekong River in Chiang Saen, targeted at families and couples.

He said funding for future projects would be raised from investment firm Asia Sense, which was established in the UK last year and held by a group of his friends, some of whom were villa buyers at Bang Kao Tropical.

"It will be not only an investment but also a way to have resorts in Asian countries' major tourist destinations where we can stay whenever we want," he added.

China Town in Singapore is one location it is looking at. Krabi, Chiang Mai, Bali and Vietnam are other destinations where it plans to open small hotels with a budget of around 50 million baht each, said Mr Verjus.

Mr Verjus came to Thailand 25 years ago and started a tour agency in Bangkok that targeted Belgian and European tourists. He felt an instant attraction to Samui and moved there in 1992 to run DJ Paradise Tour before entering the hotel business five years ago.

All is NOT Doom & Despondency !!


The Phuket & Koh Samui property markets will undoubtedly see a slowing down in 2009, however, this is not to say however that there has not been market activity.

The 2008/2009 high season has seen a good number of prospective buyers looking to buy and there has been continued interest in the resort markets.

Good value properties are available on the market, particularly resale properties, however, the market has showed no signs of major discounting. Prices have not fallen to date. Many foreign buyers who bought several years back may be prepared to sell at realistic prices as gains have already been made through time and currency. From the development perspective, there is a marked slow down on new project launches.

Despite the global financial crisis and the effects of the local political situation, hotels in Southern resort destinations have reported an average occupancy rate of 80% to 85%. Although this is a drop from an average of 90% occupancy last year, flights to Phuket remain full and tourist venues continue to be crowded.

Thailand’s resort markets, notably Phuket & Koh Samui have managed to bounce back time and time again and visitor arrivals in January bare this out. With some of the best infrastructure for boating, golfing, schooling and medical care, the two resort islands have proved to be robust, and we expect the market to recover well from the crisis.

Holding Back the Years Thai Style !


It used to be that Thailand was a perfect place to lose track of time. Now it promises even better. It is giving back time — years, even.

In cosmopolitan capitals around the world, finding the fountain of youth has re-surfaced as a bioscience rage. Scientists and doctors are making more advances in manipulating, slowing and even reversing physiological ageing through biomedical interventions.

Although Thailand has opened its medical arms to much of the new technology, its anti-aging experts have not let the science overshadow how much of the biological clock can be turned back or slowed through simple changes in diet and lifestyle.

The quest is to help people stay healthier longer by earlier detection and prevention of age-related diseases – and even reversing them. Contrary to popular perception, the focus goes well beyond the cosmetic approach of hiding wrinkles, age spots and balding scalps. Thailand’s many anti-aging experts continue to embrace the health care wisdom taught by their ancestors: balance the mind and the body.

Ageing, explain the experts, is a condition that can be controlled to some extent. Anti-aging is about getting the body in balance and functioning at peak performance, no matter how many candles appear on the birthday cake. For all anti-aging specialists, the most important outcome is quality of life. Lifespan might lengthen in this process, and for some people that is also part of the goal.

But one of the most profound insights of modern health care is the appreciation that lifestyle is a key factor in achieving healthy longevity.

“You can definitely reverse the aging process — I believe it,” says Dr Pakpilai Thavisin of S Medical Spa in Bangkok. “People misunderstand when we talk about anti-aging medicine. Hormone imbalance, vitamin and mineral supplement – most doctors are doing that. For me, it’s all about lifestyle. You age faster if your lifestyle is not right.”

Ageing usually begins around age 25–35. This is generally attributed to free-radical damage, invisible inflammations inside cells and hormone depletion. To a small degree, ‘bad’ genes play a role as well. However, there is divided opinion on the use of hormones, supplements and herbs in terms of slowing the ageing process. Some doctors believe the research is not yet conclusive on hormone therapies so they prefer to focus on natural remedies.

Slowing or Reversing the Ageing Process
Reputable doctors are quick to warn that slowing down ageing is not about waving a magic wand and presto, youth appears. Most people are degenerating at an accelerated rate and thus seem older than they should. Reversing or slowing the damage certainly helps some people look five to ten years younger. But turning back the clock, the anti-aging sages say, requires fundamental changes in lifestyle: moderate exercise, healthy food (no processed elements, lots of antioxidizing ingredients), no smoking and, most importantly, stress management. And good sleep, preferably from 10.00 pm to 6.00 am.

In a country already touted as a medical and cosmetic surgery hub and a Sensual Spa epicentre, more and more doors in Thailand are now opening towards the fountain of youthfulness. In addition to the first university courses in herbal and anti-ageing medicines, anti-aging clinics and services have been popping up in hospitals, medical spas and dermatology centres.

Integrating the Best of East and West
Much of the science is borrowed from the West. However, the small but growing number of Thailand’s anti-aging medical spas and wellness centres aim to combine Western medicine with Eastern therapies to offer integrated healthcare.

The alternative options include acupuncture, Chinese Herbal Medicine , traditional Thai Massage , traditional Thai herbal remedies, yoga and Qi Gong, Reiki and even Vipassana meditation (which has been shown to be effective in combating stress-related illnesses, in conjunction with detoxifying cleanses and/or rejuvenating vitamin and mineral supplement treatments. Many of the anti-aging centres contain a fitness gym, nutrition and cooking courses. If not under one roof, various options are typically just a few blocks away, making Thailand, though mostly Bangkok, an ideal destination for anti-aging possibilities.

Each clinic’s approach varies. Some mix both conventional and anti-ageing science with spiritual or psychological approaches more than others. Some are less concerned with outside beauty than healthy internal functioning.

“Thailand might be at the forefront in the individualizing of treatment and merging scientific and alternative medicines,” says Dr Somboon Roongphornchai, Medical Director of the Vitallife Wellness Center within the Bumrungrad International Hospital in Bangkok. Vitallife offers a fitness gym with a sports medicine doctor on hand and consultations with nutritionists. The centre recently began integrating Chinese and Thai traditional herbal medicines in its treatment recommendations.

Typically, anti-aging clinics provide some type of analysis on how fast a client’s body is ageing, or rather, degenerating, and the potential for disease. This ranges from a computer programme to laboratory tests on antioxidant, vitamin, mineral and hormone levels, inflammatory and oxidant-damage markers, blood counts, fatty acids, urine acids, insulin resistance, liver and kidney functioning and general fitness. Some places offer gene make-up analysis, though the lab tests are sent abroad.

Then consultations turn to what can be done to prevent or reverse damage through diet, exercise, lifestyle changes and hormone or herb therapies and other supplements. According to Dr Thidakarn Ratanabanangkoon, American Board-certified anti-ageing physician and dermatologist who oversees anti-ageing services at Samitivej Hospitals, treatment is three-pronged: detecting disease as early as possible rather than waiting to treat it (the conventional response); preventing disease through diet and lifestyle changes; and reversing age-related disease by supplementing vitamins, minerals and hormones and possibly exercise.

Going Well Beyond Skin Deep
“We can say beauty is a good thing but we have to think about health — have a positive environment. And we have to remember it’s not only physical — the mind has to be good too,” says Dr Orawan Kitchawengkul, a dermatologist who started anti-aging medical centres in Bangkok and Phuket. Her World-Class Anti-Aging Institute includes a heavy focus on mental health as well as inside and outside physical vibrancy: herbal hormones, meditation, acupressure, acupuncture, yoga, Qi Gong, Reiki, hydroareobics, quantum energizing, plasma technology, infrared sauna, nutrition, cooking courses — and even home delivery of healthy food.

Reducing free-radical damage — the roving by-product particles that emerge within the human body whenever cells combust (a normal function that produces energy) or from exposure to chemicals, such as alcohol, toxic metals, emotional stress, smoking and air pollution, among others — is one of the primary anti-ageing goals.

Antioxidants can remove free radicals before they have a chance to do damage. This is typically achieved with food, particularly fruits like blueberries, cranberries, strawberries, grapes and papaya; vegetables like kale, broccoli, spinach, other dark greens as well as and other 'colourful' vegetables; whole grains and pulses rich in antioxidants such as red kidney beans. Processed foods containing white flour, white sugar and saturated fats should be avoided.

Achieving Positive Change — The Natural Way !
Dr Kobkan Phiboonsin is a young general practitioner who left a hospital position to train in acupuncture and join the Balavi Natural Health Center. When she first attended a World Anti-Aging Congress seminar in the United States, she realized that what she was hearing about diet and lifestyle had been promoted at the Balavi centre for more than 30 years. “The principle is do it yourself — change. But you can do it the natural way,” she says.

“Natural takes longer for results,” says Dr Krisda Sirampuj, who recently set up the International Anti-Ageing Medicine Institute (in Bangkok), with support from the Thailand Center for Excellent Life Science, to promote his “3H” model of healthy weight, healthy eating and lifestyle, and healthy minds. Avoiding gadgets and hormone therapies, Dr Krisda believes “it is more perfect to emphasize the mind and encourage mental exercises. It seems idealistic, but it’s not. I say to patients to believe in change and stay mindful.”

Promoting the body’s natural healing ability goes even more holistic and more posh at TRIA, a unit of the Piyavate Hospital in Bangkok which offers integrative medicine – a combination of complementary, alternative, functional (anti-ageing) and conventional practices. The staff entails a homeopath, naturopath, acupuncturist, chiropractor, nutritionist, psychotherapist and counsellors as well as access to medical specialists. “Our aim is to give patients better quality of life — not more years,” says Dr Thirapan Kamchomnan, both a functional and aesthetic doctor at TRIA.

Thailand is still chock-a-block with laser and other technologies for improving youthful appearance, from coping with wrinkles, sagging chins, hair loss, cellulite and impotence. But for anti-ageing doctors like S Medical Spa’s Dr Pakpilai Thavisin, beauty is the marketing ploy. “I think when they’re here they’ll learn something,” she says. She once asked a couple who wanted to lose weight without going to the spa’s gym to walk to and from their hotel for their sessions. By day four they asked to use the gym. She says they kept walking when they returned home and made other fundamental changes in their lifestyle.

Walking in Bangkok may not be ideal for most clients, nor may the few days spent at a day facility be sufficient for making the commitment to behaviour change – despite customized regimens for eating and exercising. There are other options for longer-term wellness retreats, such as the Chiva-Som International Health Resort near the seaside town of Hua Hin. Thai Promotes Thailand !


TG and TAT team up in travel trade campaign
Some 450 tour operators and travel trade media arrived in Thailand this week for a 'mega fam trip' hosted by the Tourism Authority of Thailand and Thai Airways International. TG's acting president Narongsak Sangapong says that the objective was to reassure travellers that Thailand is a safe destination that provides value for money. Participating tour operators and journalists were being briefed on Thailand's tourism related products and services to confidently promote Thailand as a leading destination of choice.

Visa has teamed up with some 335 merchants across Thailand to offer attractive Visa cardholder promotions. It's a move designed to help boost local tourism revenues. The Visa Preferred Merchants programme offers discounts to cardholders when they use their cards at participating restaurants, shopping malls, spas and tour operators. The programme targets goods and services most commonly used by travellers and offers discounts of 10-50 percent off purchases made at participating merchants. Visa cardholders arriving at Bangkok can enjoy special promotional rates at hotels with possible savings of up to 50 percent off the hotel rack rates. These promotions will run until 14 November 2009.

Somboon Krobteeranon, country manager, Thailand, Visa said, "People want value when they travel and never more so than when times are uncertain. In the current economic climate, travel is often one of the areas where people cut back or look for cheaper alternatives while on holiday. Thailand Property STILL on Top !


According to the monthly TheMoveChannel.com Investment Property watch chart Thailand is still showing incredible resilience compared to other global investment property markets.

Thailand showed as the global leader during December, and only slipped to second spot in the January table, being pipped at the post by Egypt, which is an incredible achievement in the light of the national upheavals caused by the airport closures & general turmoil felt within the country.

Add this to the ever strengthening Thai Baht compared to the US$ & UK£, and you see quite a strong potential for growth AND returns !!.

The countries continued high ranking of second place in January shows the “Land of the Smiles” is still indeed an hot spot for property investment !.

Thailand Confidence on The Way Back Up !

The Thailand Consumer Confidence Index (CCI) rose for the second consecutive month in January 2009.

November 2008 saw the Index at its lowest (74.2) since January 2002, but since then it rose to 74.8 (December) and 75.2 (January).

The survey was undertaken by the University of the Thai Chamber of Commerce (UTCC). The results are believed to show an increase in hope amongst the Thai public partly due to economic stimulus measures introduced by the government, and also due to the current low fuel prices.

Part of the government´s package includes a range of stimuli for the domestic property industry.

As reported in the Bangkok Post: UTCC economist Thanavath Phonvichai warned that the rebound may not be sustained as it is based solely on hope.

"The country´s political conditions, the world and US economic prospects, the relatively high cost of living and unemployment are still the key factors that influence consumers´ confidence," he said.

"The government should thus accelerate implementing its economic stimulus measures to restore confidence in consumers and to spur consumption and private investment in the second half of the year."
